Regulations

These terms and conditions set out the rules for making purchases from the online shop operated by the Seller at www.dostrajamy.com.

The seller is the company :

Dostrajamy Sp. z o.o. with its registered office in Rzeszów, 2/17 Starzyńskiego Street, 35-508 Rzeszów. Registered under NIP: 5170456641, KRS: 0001159197, REGON: 541056728, also referred to interchangeably as „Service Provider”.

The Service Provider can be contacted using the email address: domisol@dostrajamy.com,

§ 1 Definitions

    1. Regulations - these Regulations. With regard to services provided by electronic means, the Regulations are the regulations referred to in Article 8 of the Act of 18 July 2002 on provision of services by electronic means (Journal of Laws of 2002, No. 144, item 1204, as amended).

    1. Customer - a natural person, a legal person or an organisational unit without legal personality but with legal capacity, who, under the terms of these terms and conditions, places an Order at the Online Store.

    1. Consumer - a customer who is a natural person using the Online Shop for purposes not directly related to his/her business or professional activity.

    1. Service Provider - the entity providing sales services via the Online Shop under the terms of these Terms and Conditions.

    1. Object of transaction - Goods listed and described on the website of the Online Shop.

    1. Goods - a movable item, presented in the Online Shop, to which the Sales Agreement applies.

    1. Additional Service - a service provided by the Service Provider to the Customer outside the Online Shop in connection with the nature of the Goods sold.

    1. Sales Contract - a contract for the sale of Goods, as defined by the Civil Code, concluded between the Service Provider and the Client, using the Store's website.

    1. Online Shop (Shop) - the website available at the web address through which the Customer may place an Order.

    1. Order - the Customer's declaration of will specifying unambiguously the type and quantity of Goods, aiming directly at the conclusion of the Sales Agreement.

    1. ICT system - a set of cooperating IT devices and software, ensuring the processing and storage, as well as sending and receiving data via telecommunication networks by means of a terminal device appropriate for a given type of network.

§ 2 General principles

    1. These Terms and Conditions set out the rules for the use of the online shop available at www.dostrajamy.com.

    1. It is a condition of placing an Order in the Online Shop that the Customer reads these Terms and Conditions and accepts their provisions at the time of Order processing.

    1. The online shop conducts retail sales via the Internet.

    1. All Goods offered in the shop are brand new, originally packaged, free from physical and legal defects, and have been legally introduced into the Polish market.

    1. As part of the technical requirements necessary to cooperate with the ICT system used by the Service Provider to make purchases, the Customer should have an active electronic mail (e-mail) account and a device connected to the Internet that meets the following minimum technical requirements:
        1. Internet Explorer version 7.0 or later with ActiveX, JavaScript and Cookies enabled or

        1. Mozilla Firefox version 3.0 or later with Java applets, JavaScript and cookies enabled,

        1. minimum screen resolution of 1024×768 pixels.

    1. The customer is obliged not to provide content that is prohibited by law, e.g. content that promotes violence, is defamatory or infringes the personal rights and other rights of third parties.

§ 3 Placing orders

    1. All prices shown on the website are gross prices in Polish zloty. Prices do not include shipping costs.

    1. Orders are accepted via the website/email.

    1. Orders placed via the website can be placed 24 hours a day, 7 days a week, all year round.

    1. The order is effective if the Customer correctly fills in the order form and correctly enters the contact details including the exact address to which the Goods are to be sent and the telephone number and e-mail address.

    1. In the event that the data provided is not complete, the Seller will contact the Customer. If it is not possible to contact the Customer, the Seller has the right to cancel the Order.

    1. In the process of placing an order, the Customer may express his or her wish to receive a receipt or a VAT invoice, which may be attached to the parcel being sent or sent electronically, to the e-mail address indicated, in the form of an electronic image of settlement documents, in particular such as: VAT invoices with attachments, correcting VAT invoices with attachments and forms. This consent also authorises the Seller to issue and send VAT invoices in electronic form, in accordance with the Ordinance of the Minister of Finance of 20 December 2012 on sending invoices in electronic form, the rules of their storage and the manner of making them available to a tax authority or tax inspection authority.

    1. When placing an Order, the Customer may give their consent to the inclusion of their personal data in the Seller's online shop's database for the purpose of processing in connection with the fulfilment of the Order. If consent is given, the Customer has the right to inspect his/her data, correct it and request its deletion.

    1. The Customer may use the option of the system remembering his/her data in order to facilitate the process of placing another Order. For this purpose, the Customer shall provide the login and password necessary to access his/her account. The Customer's login is the e-mail address provided by the Customer. The password is a string of characters set by the Customer. The Customer's password shall not be known to the Seller and the Customer shall keep it secret and protect it from unauthorised access by third parties.

    1. Once the customer has placed a successful order, they will receive an automatic response from the shop confirming receipt of the order.

    1. The start time of the order coincides with the receipt of the payment into the bank account specified in the confirmation.

    1. Personal collection - the order can be collected in person after prior appointment by e-mail and confirmation by the Seller. Failure to collect the goods in time will mean that the order is cancelled.

§ 4 Shipping costs and deadline

    1. Goods are dispatched to the address indicated on the order form or given by telephone or e-mail. The shop will inform the customer immediately if the order form is incorrectly filled in, which prevents or delays dispatch.

    1. Goods are delivered via specialised courier companies or the Polish Post Office. It is possible to collect the goods in person after prior appointment by e-mail and confirmation by the Seller.

    1. The shipment is delivered in accordance with the time indicated next to each Item on the website. The time taken for the funds to be credited to the shop's bank account should be added to the time stated on the website (usually 1-2 working days).

    1. The Customer shall be charged the delivery (shipping) costs specified in the shipping price list. The Customer can consult the price list after adding the product to the Basket.

    1. The cost of delivery of the Product depends on the chosen method of payment and form of delivery. The delivery costs according to the price list of a given supplier are available on the website www.dostrajamy.com.

    1. Price list for delivery: INPOST Paczkomaty delivery cost 18.99 PLN, delivery cost via Polish Post or DPD - only foreign parcels from 30 PLN.

§ 5 Payments

1.Payment methods 

Methods of payment for the Product are available by prepayment to the Store's bank account indicated in the Terms and Conditions:
- AutoPay: according to the terms and conditions of this service (list of supported banks and processing times are available at www.autopay.pl)
- Paypal: according to the terms and conditions of this service (list of supported banks and processing times are available at www.paypal.com)

§ 6 Withdrawal from the contract

    1. A consumer who has concluded a distance contract has the right to withdraw from the contract without stating a reason by submitting an appropriate statement in writing within 14 days (legal basis: Article 7(1) of the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by a hazardous product, Journal of Laws No. 22, item 271, as amended). This period is a non-extendable period and shall be calculated from the date of delivery of the item, and when the agreement concerns the provision of a service - from the date of its conclusion. It is sufficient to send the declaration before the deadline to the Service Provider's address.

    1. In the event of withdrawal from a distance contract, the contract shall be deemed not to have been concluded. What the parties have rendered shall be returned unchanged, unless the change was necessary within the limits of ordinary management.

    1. The return should be made immediately, no later than within 14 days. The purchased goods should be returned to the address of the Service Provider - Dostrajamy Sp. z o.o., Starzyńskiego 2/17, 35-508 Rzeszów.

    1. RETURNS
      The Buyer may withdraw from the contract without giving reasons within 14 days of receiving the goods. Goods that are not prefabricated, manufactured to the Buyer's specifications or intended to meet the Buyer's individual needs are not subject to return. In order to exercise the right of withdrawal, the Buyer must contact us by sending an email informing of the fact of withdrawal. The Buyer must send the returned Goods (protected from damage) at their own expense. The Buyer shall exercise the right of withdrawal by returning the Goods to the Seller intact, with the original tags, free from signs of use, together with a written statement of withdrawal. The downloadable completed withdrawal form can be found in the RETURNS tab under each product on the website. The form can be filled in manually. Refunds shall be made through the same payment channel as the payment, unless the Buyer and the Seller agree on a different method. The return period is 14 working days.

    1. The seller shall not be obliged to reimburse the consumer for the full shipping costs incurred by him.

§ 7 Complaint procedure

    1. If the Customer finds damage to the package during transport indicating interference of third parties, the Customer is obliged to draw up a damage protocol in the presence of the courier. Complaints arising from damage to the Goods during transport will be considered on the basis of the complaint protocol drawn up by the Customer and the courier.

    1. If the goods are not in conformity with the contract, the customer may request that the goods be brought into conformity with the contract by repairing them free of charge or replacing them with new ones, unless repair or replacement are impossible or require excessive costs. When assessing the excessiveness of the costs, the value of the goods in conformity with the contract and the type and degree of non-compliance found shall be taken into account. (Act of 27 July 2002 on specific conditions of consumer sales and on the amendment to the Civil Code).

    1. The seller is liable for the non-conformity of consumer goods with the contract only if it is established before the expiry of two years from the delivery of the goods to the buyer.

    1. Complaints should be submitted to the Service Provider's email address: domisol@dostrajamy.com.

    1. The service provider will consider the complaint within 14 days from the day the complaint was filed. If the complaint is considered in favour of the Customer, the service provider will repair or replace the advertised goods with new, full-quality goods or refund the value of the purchased goods.

§ 8 Amendment of the Rules of Procedure

    1. Customers with a Shop account will be informed of the change to the Terms and Conditions via email correspondence.

    1. If there has been a change to the Store Terms and Conditions during the time that has elapsed since the last login, the Customer accepts or does not accept its provisions after the changes. If the Customer does not accept the terms of the Terms and Conditions, in particular after its amendments, shopping in the Online Shop is not possible.

    1. A customer who does not accept the changes introduced in the Terms and Conditions is entitled to delete his/her account at any time.

    1. Orders placed by customers before the amendments to the Terms and Conditions came into force will be processed in accordance with the previous provisions of the Terms and Conditions.

§ 9 Final provisions

    1. In matters not covered by these Regulations, the provisions of the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by dangerous products (Journal of Laws 2000 No. 22 item 271 as amended), the Act of 27 July 2002 on special conditions of consumer sale and amending the Civil Code (Journal of Laws 2002 No. 141 item 1176 as amended), the Act of 23 April 1964. - Civil Code (Dz.U. 1964 no. 16 item 93 as amended).

    1. Disputes arising from the application of these Rules and Regulations and in connection with the performance of contracts concluded between the Shop and Customers will be considered by the Court with jurisdiction over the subject matter and place of jurisdiction in accordance with the Act of 17.11.1964 Code of Civil Procedure (Journal of Laws No. 43, item 296, as amended).
